With the UK now steamrollering towards crashing out of the EU on 31 December 2020, it’s inevitable that UK Suppliers and UK Buyers will no longer be able to access Tenders published in the Supplement to the Official Journal of the European Union (OJEU).
To fill this gap there will be a new service launched on 31 Dec for the publication of opportunities above the OJEU Threshold. This new UK e-notification service is called Find a Tender (FTS) and will go live for all publications after that date.
For all the Brexiteers who thought this would be the end of EU involvement, think again. Under the terms of the UK Legislation for exiting the EU – The one that brought in the Transition Period ending on 31 December, there is provision for extended EU influence.
The legislation allows for any contracts that arise after 1 January to still be subject to the jurisdiction of the European Court of Justice where:
They arise from a Framework Agreement that was in place prior to 31 December – That could be for a period of up to 4 Years!
They arise from a Dynamic Purchasing System that was in place prior to 31 December – That could be up to 7 years!
Any new contract concluded after 1 January which arises from a contract notice published before 31 December – That is open ended>
So it’s clear that we will be taking back full control sometime after the end of the Transition Period, but we don’t quite know when
